و الاصل العام انه يجوز للمدين ان يحيل الى دائنه حقوقه بذمة مدين اخر , إلا اذا كان هناك نص فى القانون يمنع الحوالة , و ذلك بالنظر الى كل حالة على حدة او ان طبيعة الحق مما لا تجوز حوالته او ان هناك اتفاق بين الطرفين ( عميل البنك و المدين ) على عدم جواز الحوالة و هذا الامر أساسه الاتفاق بين الطرفين فهناك عقود و اتفاقيات يتم النص بها صراحة على حظر حوالة الحق
