تناول البحثُ موضوعًا في غايةٍ من الأهمِّية متمثِّل في مسألة الاجتهاد الفقهي، ويُعَدٌّ هذا الموضوع منْ أبرزِ القضايا التشريعية القديمة و المعاصرة ذات الشَّأن، لكونِ طلاحيته تواكب تطوُّر العصر ومستجدَّاته ،وقدْ عمدَ العديد من العلماء المعاصرين إلى ضرورة إعادة النَّظر في مسألةِ الاجتهاد للتغيُّرات الطَّارئة التي يعيشها الواقع . ونظراً لحداثة هذا الموضوع جاءت هذه الورقة البحثية لتقديم رؤية في الاجتهاد الفقهي المعاصر بهدفِ الكشفِ عن طبيعتةِ من حيث المفهوم والضوابط، ، وقدْ اتَّبعت الباحثة المنهج الوصفي متوصِّلة إلى أنَّ مسألة الاجتهاد لا تتوقَّف ولا تنتهي لكونها قضية مستمرَّة ومتجدِّدة بتجدُّد العصر وظروفه ، وأنه في ظل هذه التغيرات والمؤثرات لاينبغي أن يتخلى عن الثوابت والأصول، وضرورة مدارستة بجدِّية وبعمق، لكونه يعزِّز آلية من آليات الشَّريعة الغرَّاء ،وأن هناك ثمَّة ضوابط إذا ما أحكم تطبيقها أصابت الاجتهاد في مقتل . الكلمات المفتاحية : الاجتهاد الفقهي ، المفهوم ، الضوابط
