مواد القانون والمبادئ العامة التى تحكم الموضوع :-
أولا:- المادة (32) من قانون العمل العماني – والمبادئ المتصلة بها
تنص المادة (32) على اذا نسب الى العامل ارتكاب جناية او جنحة داخل مكان العمل جاز لصاحب العمل وقفه عن العمل لمدة لا تجاوز ثلاثة أشهر من تاريخ ابلاغ السلطة بالحادث ويحرم العامل عن أجره الشامل من الشهر الاول ويصرف له نصف اجره الشامل في الشهر الثاني والثالث فاذا رأت تلك السلطة عدم تقديم العامل للمحاكمة أو انقضت مدة ايقافه عن العمل او قُضي ببراءته وجب اعادته الى عمله مع رد ما سبق وقف صرفه من الاجر اليه فاذا امتنع صاحب العمل عن ذلك اعتبر عدم اعادته فصلاً تعسفياً مع الزام مع الزام صاحب العمل برد ما سبق وقف صرفه عن الاجر للعامل في جميع الأحوال .
