1- لعل أول إنتقاد يمكن توجيه للتعديلات التي تمت على اتفاقية الاستثمار العربية هى أنها لم تقيم نواعاً من التوازن بين ضمانات توفير حماية فعالة وامتيازات للمستثمرين العرب وأهمية المحافظة في الوقت ذاته على حقوق الدول المضيفة للاستثمار ومصالحها العامة المشروعة في تحقيق أهداف التنمية المستدامة . وهو التوازن الذي تحرص عليه حالياً اتفاقيات الاستثمار الدولية .
2- يمكن القول – بصفة عامة - بان التعديلات اهتمت بالتركيز على مصالح المستثمر العربي ومنحه الامتيازات والضمانات ، ولم تهتم كثيراً بالاحكام الخاصة بمساهمة الاستثمارات العربية فى خطط وبرامجة التنمية في الدول العربية المضيفة للاستثمار، حيث أن الابعاد التنموية للاستثمار لم تكن ضمن أولويات التعديلات التي تمت على الاتفاقية العربية.
