الإحتياط القانوني وهو الحد الأدنى من الإحتياطي الذي لابد للشركة من تكوينه (و حدده القانون% 5 من صافي الأرباح على أن لا يتعدى 10%من رأس مال الشركة ) و يستخدم في تغطية خسائر الشركة و في زيادة رأس المال .
