إذا كان العامل خاضعا لفترة تجربة، وجب النص على ذلك صراحة في عقد العمل، و تحديدها بوضوح، بحيث لا تزيد عن تسعين يوما، و يجوز بإتفاق مكتوب بين العامل و صاحب العمل تمديد فترة التجربة، على الا تزيد عن مائة و ثمانين يومًا، و لا تدخل في حساب فترة التجربة عيدي الفطر و الاضحى و الاجازة المرضية و لكل من الطرفين الحق في انهاء العقد خلال هذه الفترة ما لم يتضمن العقد نصا يعطي الحق في الانهاء لاحداهما
