يعتبر التلوث البيئي بالنفايات الطبية أخطر انواع النفايات صنفت ضمن النفايات الخاصة الخطرة حددت لها اتفاقية بازل طرق التخلص منها ونقلها عبر الحدود، وأتى القوانين الجزائرية متوافقة مع التعهدات الدولية بعد المصادقة بتحفظ على اتفاقية بازل2005، حدد خلالها قانون الصحة الجزائري 2018 تاكيد حماية البيئة من مخاطر النفايات الطبية متوافقا مع قانون حماية البية 2003 وقانون تسيير النفايات2001 للتخلص من هذه النفايات وازالتها ونقلها، وأقر القانون الجديد 19-10 تصدير النفايات الخاصة الخطرة بما فيها النفايات الطبية كإستثناء لعدم وجود منشأت معالجة لإزالة هذه النفايات .
