7. إذا لم يتوصل الطرفان إلى اتفاق بشأن التحكيم يحق للجمعية في هذه الحالة إنهاء العقد وخصم كافة الخسائر التي تكبدتها أثناء فترة الخلاف وذلك من ضمان الأداء أو من المبالغ المستحقة أو التي ستستحق للمقاول أو المورد لدى الجمعية ويحق للمتضرر اللجوء إلى القضاء.
