يجوز للجنة المناقصات في حالة رفض صاحب العطاء الفائز تقديم ضمان الاداء أو الحضور لتوقيع العقد خلال المدة المحددة في اخطاره بإرساء المناقصة عليه يتم الانتقال إلى مقدم العطاء التالي في الترتيب من حيث أقل الأسعار المقيمة والمستوفية للشروط والمواصفات ويتم اخطاره للحضور للتعاقد معه ،
