6- استبدلت عبارة ( المواطن العربي )

6- استبدلت عبارة ( المواطن العربي ) بعبارة ( المستثمر العربي ) فى المادة (1/6) من الاتفاقية المعدلة. وتعد عبارة المستثمر العربي أفضل في الصياغة لأنها تتفق مع كون الاتفاقية تهدف إلى توفير الحماية للمستثمر العربي وليس المواطن العربي.
7- عالجت التعديلات حالة الشخص الطبيعي مزدوج الجنسية والتي تكون إحداها جنسية الدولة المضيفة للاستثمار. حيث اشترطت صراحة المادة (1/8) من الاتفاقية المعدلة عدم تمتع الشخص الطبيعي بجنسية الدولة التي يقوم بالاستثمار فيها ( الدولة المضيفة للاستثمار) حتى ينطبق عليه وصف المستثمر العربي . ومن ثم يستفيد من الحماية الواردة فى الاتفاقية . وهو الحكم الذي لم يكن موجودا فى الاتفاقية العربية قبل تعديلها.
