فان محكمة الموضوع غير ملزمة بتتبع المتهم في شتى مناحي دفاعه الموضوعي والرد على كل شبهة يثيرها اكتفاء بادلة الثبوت التي اوردها الحكم ، وهو ما ذهب اليه قضاء المحكمة العليا ، فقد ورد ذلك في الطعن رقم 547/2014 الدائرة الجزائية بالمحكمة العليا ولذلك فان هذه الدفوع تلتفت عنها المحكمة .
