تنص المادة (95) من قانون الجزاء على

تنص المادة (95) من قانون الجزاء على ان المتدخل الفرعي / كل من ساعد الفاعل على تهيئة الوسائل او اتمام ارتكاب الجريمة او شدد عزيمته او ارشده الى ارتكابها ، او كونه اتفق مع الفاعل قبل ارتكاب الجريمة او كان على علم بخطة الاشرار الجنائية .
ويتضح من هذا التعريف ان التدخل الفرعي لا ينشأ الا بتوافر العلم بالجريمة ووجودها سواء قبل او خلال او بعد ارتكابها والقول بغير ذلك يعتبر خطأ قانوني فادح لا يغتفر لانه متعلق بحرية المتهمين وحياتهم.
ومن التحقيقات والمستندات المقدمة من محامى جميع المتهمين نوضح الاتي لنفي علم وارادة المتهم السابع بوجود اي مخالفة او نية جريمة :
