ولما كانت المادة 11 مكرر من القانون 25 لسنه 1929 المضافة بالقانون 100 لسنه 1985 قد نصت علي انه اذا امتنعت الزوجة عن طاعه الزوج دون حق توقف نفقه الزوجة من تاريخ الامتناع وتعتبر ممتنعه غذا لم تعد لمنزل الزوجية بعد دعوة الزواج اياها للعودة بالاعلان علي يد محضر بشخصيها او من ينوب عنها وذلك في خلال ثلاثون يوماً من تاريخه .
