لكل ما سبق من اسباب وفقا للقانون ,

لكل ما سبق من اسباب وفقا للقانون , اننا ونيابة عن المدعي نلتمس الحكم بالطلبات الآتية :
ثانيا : الطلبات :
1. على وجه الاستعجال : الزام الشركة المدعى عليها برفع الرهونات والحجوزات الموضوعة على الاليات والمعدات والسيارات العائدة للمدعية والمرهونة لصالح المدعى عليها .
2. الزام الشركة المدعى عليها بأن تدفع للمدعية مبلغ وقدره (480/60,001 ر.ع) (ستون الفا وريال عماني واحد واربعمائة وثمانون بيسه) لقاء المبالغ الزائدة التي تحصلت عليها المدعى عليها زيادة عن مبلغ التسوية المتفق عليه بين الطرفين .
3. الزام المدعى عليها بأن تعيد للمدعية كامل الشيكات التي بحوزتها .
4. الزام الشركة المدعى عليها بأن تدفع للمدعية مبلغا وقدره (50,000,000 ر.ع) خمسين مليون ريال عماني) كتعويض عن الاضرار التي لحقت بالمدعية وما فاتها من كسب من جراء امتناع المدعى عليها عن تنفيذ عقد التمويل والتسوية المبرمين مع المدعية .
5. الزام المدعى عليها بارجاع قيمة التأمين والبالغ (25,000 ر.ع) (خمس وعشرون الف ريال عماني) والذي خسرته المدعية بسبب عدم فك رهن المعدات .
6. الزام المدعى عليها بمصاريف الدعوى واتعاب المحاماة البالغة (50,000 ر.ع) (خمسون الف ريال عماني) .
احتياطيا :
1. احالة الدعوى للخبرة الفنية لتحقيق عناصر الدعوى .
2. احالة الدعوى للتحقيق لاثبات التسوية واثبات اخلال المدعى عليها الالتزام ببنودها .
