يتحمل الطرف الثاني تكاليف عودته الى بلده مع احتفاظ الطرف الأول بحق الحصول على تعويض إضافي من الطرف الثاني مقداره أجر أساسي لثلاثة أشهر كحد أدنى قابلة للزيادة حسب سبب الفصل ومقدار الضرر
