واما عن طلب الادعاء العام طرد المته

واما عن طلب الادعاء العام طرد المتهمين من البلاد استنادا لنص المادة (48) من قانون الجزاء وابعاد المتهم الاول من البلاد عملا بنص المادة 114 من قانون العمل ،
وحيث ان المادة سالفة الذكر قد اجازت فرض عقوبة الطرد في حالة الحكم بعقوبة تأديبية من اجل جنحة وكان الجرم مخلا بأمن البلاد او بالاخلاق العامة ، والتي لم يوردها القانون على سبيل الحصر ، وانما مصطلح الاخلاق العامة ينصرف الى كل ما من شأنه ان يؤثر على السلوك السوي والصفات الحميدة التي ينبغي للفرد والمجتمع التحلي بها ، فمن غير المتصور ان لا يكون تداول سلعة فاسدة والبعد عن مبدأ الصدق والامانة في التعامل هو غير ذات مساس بالاخلاق العامة التي تتنافى مع عدم المصداقية في التعامل ، وعليه فالمحكمة تقر هذا الطلب وتحكم به حسبما يرد في المنطوق ، فضلا على ان الامر بابعاد المتهم الاول من البلاد ، يتوافق مع نص المادة 114 من قانون العمل وعليه فان المحكمة تقر الطلب وتقضي به حسبما يرد في المنطوق .
