وقد قدم القانون العنصر المعنوي وتوافره على العنصر المادي وعرف في الجرائم الغير مقصودة على انه الخطأ المنتج لضرر على الغير من اهمال الفاعل او قله احترازه او عدم مراعاته للشرائع او الانظمة .
وفي الجرائم المقصودة يرتكز العنصر المعنوي على الدافع وهو العلة التي تحمل الفاعل على الفعل او الغاية القصوى التي يتوخاها منه حسب المادتين (83) و (84) من نفس القانون .
