توجيه المخالفة لشركة اوربك كونها هي مالكة للمشروع و المستفيدة منه , و ان الشركة الاخيرة لم تزاول تلك الاعمال ومخالفتها كونها مالكة المشروع يتنافى مع مبدأ شخصية الجريمة والعقوبة والذي يقضي بعدم مسائلة الشخص عن جريمة لم تكن نتيجة لنشاطه الاجرامي ،
