وبجلسة (10/6/2014 ) حكمت المحكمة بقبول كلا الاستئناف شكلا , وفي الموضوع بتعديل الحكم المستأنف نزولا بالتعويض المحكوم به الى مبلغ (53000 ر.ع) ثلاثة وخمسين الف ريال عماني ومبلغ (100 ر.ع) مائة ريال عماني عن اتعاب المحاماة وتأييده فيما عدا ذلك والزام الشركة المستأنف ضدها بالمصاريف.
فلم ترضى الطاعنة ايمان بالحكم وقررت الطعن عليه بالنقض امام المحكمة العليا والتي حكمت بجلسة (15 مارس 2015) بقبول الطعن شكلا وفي الموضوع بنقض الحكم المطعون فيه واحالة الدعوى الى المحكمة التي اصدرته لتحكم فيه بهيئة مغايرة والزمت المطعون ضدها المصاريف وامرت برد الكفالة للطاعنه.
وحيث جاء بحيثيات حكم النقض ان الحكم المطعون فيه كان خاطئا فيجب أن يشمل الحكم بجميع عناصر الضرر وموقعها من جسم المضرور وما الت اليه حالة من فوات نفع او حدوث ضرر وما احتاجته تلك العناصر من تدخل طبي للعلاج وما تحتاجه مستقبلا ان كان تم دليل على ذلك ومعرفة ما يجب لكل عنصر من تعويض مناسب بموجب احكام الديات والاروش .
واتباعا لحكم النقض تداول نظر الدعوى امام هيئة استئنافية مغايرة للهيئة التي اصدرت الحكم وتداولها امامها فحضر وكيل المستأنفة وطلب رفع مبلغ التعويض لموكلته الى مبلغ (155000 ر.ع) مائة وخمسة وخمسون الف ريال عماني كما حضر وكيل المستأنف ضدها وطلب بنزول المبلغ المحكوم به الى (13250 ر.ع) .
وحيث ان المحكمة قررت حجز الاستئناف للحكم بجلسة (29/12/2015م) .
وحيث انه عن الشكل فقد تم الفصل فيه بالقبول من قبل الهيئة الاستئنافية السابقة .
وحيث انه عن الموضوع فان المستأنفة تعرضت من جراء الحادث عدة اصابات ويتم تعويضها بموجب احكام الديات والاروش ويستبين من خلال ما اجرته هذه المحكمة من رصد الاصابات وما يقابل كلا منها على حدة وذلك فيما يرد بياننه الاتي :
