بتاريخ 2472007 قدم المدعى الدعوى مدنية رقم 15672007 حيث اودعت الصحيفة أمانة سر المحكمة الأبتدائية فى مسقط , حيث طالبت ا بإلزام المطعون ضدها بأن تسدد لها مبلغ قدره خمسون ريالا عمانيا , وتسعمائة ريال عماني , وأربعة آلاف ريال عماني وذلك عن الفترة الإيجارية من تاريخ 162007 حتى 3182007 , ومبلغ ألف ريال عماني أتعاب المحاماة , استنادا على ان المدعي تمتلك المبنى السكني رقم ....... جنوب ...... ولاية ..... وأن المدعي عليه (المطعون ضده ) استأجر منها هذا المبنى لمدة سنة واحدة تبدأ من 162007 وتنتهي في 3152007 بإيجارشهري قدره ألف ريال عماني وتسعمائة وخمسون ريالا عمانيا تدفع مقدما كل ستة أشهر بواقع تسعة آلاف ريال عماني وتسعمائة ريال عماني
خلال المدة التي تعرضت لها السلطنة للإعصار الذي تضررت به كثيرا من المباني والمنشآت لم تسلم المدعي الطاعنة المبنى المؤجر للمطعون ضده , وبعد استقرار الوضع بدأت بالإصلاحات والتعديلات الواجبة عليها حول المبنى لتمكين المطعون ضده من الانتفاع بالعين المؤجرة إلا أنها فوجئت بأن المطعون ضده قامت بإلغاء العقد دون سابق إنذار.
حضر وكيل المدعى عليه وقدم مذكرة تفيد أن موكلته لم تستلم العين المؤجرة ولم تنتفع بها أصلا وطلب رفض الدعوى .
