عقد بيع أراضي بمنطقة جبل علي الصناعية بدبي
إنه فى يوم ........ الموافق ..../...../2015 تم الإتفاق بين كلاً من :-
1) السيد / ثامر مناحي صنهات العصيمي – كويتي الجنسية – جواز سفر رقم /...............ويمثله فى التوقيع على هذا العقد السيد/ناصر سعد عبدالله العتيبي بموجب وكالة مؤرخة في ..../.... / ....... " طرف أول - بائع "
2) السادة / 1- أحمد أنور قاسم (AHMED ANWAR KASAM) – هندى الجنسيه – جواز سفر رقم (H6099792) – المقيم فى إمارة دبى - دولة الإمارات العربيه المتحده .
2- رينالد دوفيل (RAYNALD DOUVILLE) – كندى الجنسيه – جواز سفر رقم (GC649102) – والمقيم فى إمارة دبى – دولة الإمارات العربيه المتحده . " أفراد الطرف الثانى - مشترى "
تمهيد
لما كان الطرف الأول يمتلك قطع الأراضي ارقام(503/504/505/506/507/508/509/510/511/512) والكائنة فى منطقة جبل علي الصناعية بإمارة دبي – دولة الإمارات العربية المتحدة – ولما كان أفراد الطرف الثانى قد إطلعوا على أوراق ومستندات هذه الأراضي وعرضوا رغبتهم فى شرائها ، وقد إتفقوا على البنود الآتيه :
أولا ً
يعتبر التمهيد السابق ووثائق ملكية الأراضي المباعة وجوازات سفر أفراد الطرف الثانى جزء لا يتجزء من هذا العقد ومكملاً له.
ثانياً
باع وتنازل الطرف الأول إلى أفراد الطرف الثانى الذى قبل ذلك قطع الأراضي المذكورة بالتمهيد والكائنة فى منطقة جبل علي الصناعية بإمارة دبي – دولة الإمارات العربية المتحدة ، والتي تمثل الأرقام (1711/599 ، 1712/599 ، 1713/599 ، 1714/599 ،1715/599 ،1720/599 ، 1721/599 ، 1722/599 ، 1723/599 ، 1724/ 599 ) .
ثالثاً
يقر أفراد الطرف الثانى بأنهم عاينوا الأراضي محل هذا العقد المعاينه التامه النافيه للجهاله ، كما إطلعوا على كافة المستندات الخاصة بها لدى الجهات المختصه ووافقوا على التعاقد والشراء .


رابعاً
إتفق الطرفان على أن إجمالي ثمن هذه الأراضي فقط مبلغ -/ 125,000,000 درهم إماراتي ( فقط مائة وخمسه وعشرون مليون درهم إماراتي ) يتم سدادها من أفراد الطرف الثانى على النحو التالى :-
1- مبلغ بقيمة -/ 76,530,385 درهم إماراتي ( فقط سته وسبعون مليون وخمسمائة وثلاثون ألف وثلاثمائه وخمسه وثمانون درهم إماراتي) يتم سدادها حسب الإتفاق بين أطراف التعاقد مع / مصرف دبى الإسلامى .
2- مبلغ عربون بنسبة 10% بواقع 12,500.000 درهم إماراتى ( فقط إثنتى عشر مليون وخمسمائة ألف درهم إماراتى ) تسدد بموجب شيك لصالح الطرف الأول .
3- سداد مستحقات شركة القنديل للمقاولات حسبما متفق عليه بين الأطراف .
4- سداد مستحقات مؤسسة رواد الخبره للإستشارات الهندسيه حسبما متفق عليه بين الأطراف .
5- كما يلتزم أفراد الطرف الثانى بسداد المتبقى من الثمن مخصوماً منه المبالغ المذكورة لصالح الطرف الأول .
خامساً
بعد إنجاز الطرفين للبند رابعاً يقوم الطرف الأول بتحويل ملكية الأراضي المذكورة إلى أفراد الطرف الثانى .
سادساً
إتفق الطرفان على أن مدة تنفيذ هذه الإتفاقيه خلال 45 يوماً من تاريخ تحرير هذه الإتفاقيه .
سابعاً
فى حالة عدم إلتزام افراد الطرف الثانى بسداد الشيكات حسب البند رابعاً يحق للطرف الأول مصادرة مبلغ العربون حالاً .
ثامناً
يتحمل الطرفين سداد رسوم التسجيل مناصفةً 50% من رسوم نقل الملكيه والتسجيل ، كما يلتزم الطرف الأول بسداد 2% عموله دلاله شريطة تنفيذ العقد بشكل نهائى وقبض الثمن وتحويل الملكيه .
تاسعاً
حرر هذا العقد من نسختين بيد كل طرف نسخه للعمل بموجبها عند اللزوم مع إثبات ما تقدم ونفاذ مفعوله .
